CLEVELAND ATHLETIC CLUB HOUSE RULES

1. HOURS OF OPERATION
While we want you, the Members of the Cleveland Athletic Club, to feel the Cleveland Athletic Club is your downtown
home, we need to make our Members aware that the Club is not a 24-hour operation. The Athletic Department is open Monday through Friday from 6am - 9pm; Saturday from 8am - 5pm; and Sunday from l0am - 3pm. (Closed on Sundays from Memorial Day to Labor Day). The locker rooms are open until 9:30pm, Monday through Friday, 5pm on Saturdays and 3pm on Sundays (when the
Club is open). From time to time, the General Manager will publish the hours of operations for the Bowling Center, dining facilities, and other summer hours. Members and their Guests are expected to leave the Athletic Department, Fitness Complex and facilities, the Bowling Center and the dining facilities upon their closing. The front desk personnel are instructed to restrict admittance into the Club after hours. Hours of operation are for your protection as well as for the protection of the Club. They need to be respected. Hours are subject to change at the direction of the Board or management.

2. ENTRANCE TO THE CLUB
Members and Guests may enter or exit the Club through the main entrance on Euclid or the rear entrance. Members entering the Club are required to scan their identification cards or provide their Member number to the receptionist at the front desk. Guests will be required to state the nature of their visit and may be required to complete paperwork or show identification for
admittance to the Club. Out of respect for Members conducting business at the Club, Members and Guests are discouraged from entering the Club wearing athletic attire Monday through Friday between the hours of 8:00am and 4:30pm. If athletic attire must be worn at this time, Members and Guests may use the front or rear entrance to the Club but should immediately proceed to the rear elevator.

3. ELECTRONIC COMMUNICATION POLICY
The use of cell phones and all other electronic communication devices (collectively, “Electronic Devices”) is strongly discouraged in the Club. Electronic Devices must be set on silent/vibrate mode upon entering the Club. Electronic Devices may only be used in the following areas for communication purposes: Taverne on Six (bar only), seventh floor elevator lobby, eighth floor
private meeting and dining rooms, tenth floor women’s locker room, eleventh floor men’s locker room, and the fifteenth floor Bowling Center lobby. The use of any Electronic Device for photographic or recording purposes on the tenth, eleventh, twelfth, thirteenth, fourteenth, or fifteenth floors is prohibited without the Club’s prior express consent. Use in other areas is limited so as not to disturb other Members or Guests.

5 CLUB GUESTS
Members act as sponsors for their Guests, and are responsible for all charges incurred by or damages caused by any Guest, and for the conduct of any Guest while on Club premises and adjacent areas outside. The General Manager will prepare and disseminate the rules for any Guest unaccompanied by a Member. Athletic Department Guests: A $10.00 Guest Fee for each Guest shall be charged at all times to the accompanying
Member’s account, except on announced family nights and special events designated by the General Manager, when the Guest Fee will be waived for all Guests.

Basketball Court Policy: A Member may invite one (1) Guest per visit to use the Athletic Department gymnasium
facilities.

Other Athletic Facilities: A Member may invite two (2) Guests per visit to use the Athletic Department facilities (other than the gymnasium) during the Athletic Department’s regular operating hours.

Athletic Groups: A Member may bring a group of Guests to use the Athletic Department facilities provided the Member makes prior arrangements with the Athletic Director specifying the number of Guests to avoid any conflicts with scheduled programs, other parties, or recognized activities of the Club.

Priority of the Facilities: Members guests will be provided equal use of the facility during their visit. From time
to time, rules will be published to monitor the rotation of the athletic facilities and equipment to provide equal access to all who wish to participate.

Guest Limitation: Each Guest may use the Athletic Department a total of only one (1) time per month, even
though more than one Member may wish to invite the same Guest during that month.

6 DRESS CODE
The Club desires to present the best possible image to the business and professional community and wishes to retain the reputation for dignity and decorum that has been traditional at the Club. 7th Floor Regency Room and the Taverne on Six requires the dress code “CAC Casual” during lunch and dinner hours and in the Bowling Center at all times unless otherwise permitted on special occasions as announced by the General Manager.
Dress code in the Bowling Center during league play and events is further subject to rules established by the Bowling Committee. “CAC Casual” is defined as: Tailored slacks, sweaters, turtlenecks, and collared business or knit shirts. Sweats, T-shirts, shorts, work-out apparel, and tank tops are prohibited. Tailored shirts and pants ensembles are also listed as acceptable for
women.

Jeans and shorts will be permitted in the 6th Floor Bar Area only on Game Days and Fridays. “Game Days” are
defined as professional Cleveland sporting events that occur at home, which includes the Indians, Browns, and Cavaliers.

Jeans or shorts must be worn with an appropriate collared shirt (i.e., button down, golf shirt, sweater or turtleneck) and must be tasteful. No holes, rips, low cut or other inappropriate looking apparel will be permitted.
Special Events - Dress Code requirements may be modified as shall be published by the General Manager for special events.

Management reserves the right to deny access to all or part of the Club or require a Member or Guest to leave the Club if in improper attire.

8 CLUB CANCELLATION POLICY
Unless otherwise stated, cancellations received within 48 hours prior to a special event will be charged at a rate of 100% of the reservation amount. If multiple reservations are made under one Member account, the cancellation fee will still be 100% of the reservation amount (i.e., the event cost per person times the number of reservations made). “No Shows” will also be billed the entire amount of the scheduled event. This policy may be waived in the event of emergency situations subject to the discretion of the General Manager.

9 PRIVATE PARTIES
The Club has a variety of rooms and amenities to accommodate Member-sponsored private parties. There may be a charge for the room use. Private parties are considered social functions and are still governed by the House Rules of the Club. Exceptions to certain requirements may be made at the discretion of the General Manager or other appropriate staff Member responsible for the function. The Member is considered a host and will be personally responsible for all financial obligations related to the function.

Members will also be held financially responsible to the Club for any charges incurred or damages caused by themselves, family members, or Guests.

10 BEVERAGES AND FOOD
Alcoholic beverages will not be sold to any person contrary to the law in the State of Ohio. No Member or Guest will be permitted to bring upon Club premises any alcoholic beverage contrary to the rules and regulations of the State of Ohio Liquor Control Board or any other applicable state agency, or contrary to these House Rules or to any policies promulgated by the General Manager under the supervision of the Board of Directors. No food or beverage is to be brought into the Club by Members or
Guests. All beverages and food consumed within the confines of the Club shall only be obtained from the Club and charged to the Members. The General Manager, with the consent of the Board of Directors, may prepare and publish an “Alcohol Service Policy” as he or she believes necessary. A 20% service charge is added to all Food & Beverage Charges. Members are required to provide their
name and Membership number prior to being served. All Members are responsible to verify the accuracy of any charges, and are required to sign their name and Membership number on their checks prior to leaving the Club. A Member who fails to do so loses his or her right to protest any charge.

11 CHILDREN
Parents, not the Cleveland Athletic Club, are responsible for the supervision of their children unless they are under the supervision of the day care personnel. Parents are also responsible for the charges incurred by, and the acts and conduct of, their children and Guests of their children.
Children under the age of 12 years old in the Club must be accompanied by an adult Member at all times. We ask that parents with children under 12 years use the Family Locker Room on the 10th Floor.

Children must be at least 14 years old to use the Fitness Complex/facilities. Children between 14 and 16 years old may enter the Fitness Complex/facilities only if accompanied by an adult Member. Children over 16 years old may use the Fitness Complex/facilities unaccompanied. Fitness Complex/facilities includes any strength training equipment, all cardiovascular
equipment, and Aerobic Studio.

Children under 18 years old must be accompanied by an adult Member at all times in the following areas: Turkish
Bath, Jacuzzi, Sauna, Steam, Golf Room, Gymnasium, Running Track, Squash Courts, Swimming Pool (unless a life guard is on duty) and for lunch or dinner in the Taverne On Six.

12 CHARGES AND PAYMENT
Members may pay food and beverage charges at the 7th Floor Regency Room, the Taverne on Six, and the Bowling Center on the Member “chit,” or check. To do this, Members simply provide their Member number and name to the service staff upon ordering. Members may also use chits to purchase items from the pro shops and to pay for events, among other things. Chit slips
are available in the Athletic Department pro shop and are on the honor system. Members take the desired item and fill out the chit slip with their Member name, Member number, a description of the item(s) and the amount(s). All chit expenses occurring during the billing period will appear on the Member’s monthly bill.

Membership dues are billed in advance and cover the month during which the statement of account is issued. Charges other than Membership dues shall be accumulated during the current month and will be included in each Member’s statement of account to be mailed on or about the first day of the month following. The balance reflected on the statement shall be due and payable upon receipt through credit card, electronic funds transfer, or by check in cases exempted by management, and in all cases the Club should receive payment no later than the 25th day of the current month. A late charge of 2% shall be charged to amounts not paid by the 25th day of the current month. A late charge of 2% as well as an additional $15.00 shall be charged on all accounts 30 days past due. If a Member fails to pay their account in full within 30 days of the billing date, their name shall be placed on the internal Stop Service Listing and all Club credit privileges shall be immediately suspended. In addition, the Member’s name shall be posted
in each elevator lobby as a delinquent account. Effective 60 days after the billing date, if the Member’s statement for that date has not been paid in full, the account shall be referred to the Board of Directors for review and further action, including, but not necessarily limited to termination. The Board of Directors shall review Member accounts on the Stop Service Listing each month. Continued failure to pay past due amounts may result in termination of Club Membership. Recovery plans may, in some cases, be made for delinquent accounts subject to approval by the General Manager and the Board of Directors. In such cases, the Club Controller
should be the first point of contact.

13 MEMBER WEBSITE
The Club website is www.clevelandathleticclub.com. The website posts general club information, the aerobic studio
schedule and Member roster, among other things. The CAC Member Directory is strictly for personal use and should not be used for commercial purposes. The Club adheres to a strict privacy policy. Any violation of this policy should be reported to the General Manager and will be subject to the remedies outlined under “Violation of Rules.”

14 LOSS OR PERSONAL PROPERTY
The Club is not responsible for any losses of or damage to personal property of Members, Guests, or visitors while in,
around, arriving and leaving the Club. Property may be deposited with the person in charge of the first floor desk or with the General Manager and a receipt for this property must be obtained. The General Manager may make other such rules as may be necessary to govern the protection of such personal property.

15 POSSESSION OF WEAPONS
Because of the potential hazard to Staff, Members and Guests, guns and other weapons are prohibited from the Club premises at all times.

16 RECIPROCAL CLUBS
A Member must obtain, upon request, directed to Member Services, an introductory letter entitling that Member to use of the facilities of the reciprocal club 72 hours in advance of a planned stay at a reciprocal club. Member’s accounts must be current to utilize this benefit. Members must contact the reciprocal club directly to make arrangements for their stay. Members are responsible for the conduct of, and any charges incurred or damages caused by themselves and/or their Guests at the reciprocal club. Member Services will provide a list of reciprocal clubs to Members.

17 RESIGNATIONS
The Manager must receive a formal letter of resignation, with the reason clearly stated, no later than the 15th of the month prior to the month in which the resignation is to take effect. All charges incurred during that last month of Membership must be paid in accordance with the Club’s payment policy. Resignations become final subject to fulfillment of all remaining obligations and approval by the Board of Directors.

18 LEAVE OF ABSENSES
Members who wish to take a leave of absence must submit a written request with a reason to the Club’s Membership Director by the 15th of the month prior to the month they wish the leave to be effective. All approved leaves are for a one-year minimum. All account charges must be paid in full prior to commencement of the member’s leave of absence. There is a fee of $10 (plus tax) per month debited to the respective member’s credit card on file while he or she is on a leave of absence. If a member wishes to return before being on leave for at least one year, he or she must first pay for all Club dues that to date had been waived while the member was on the leave of absence. In all cases, members returning from leaves will be responsible for any assessment or capital campaign charges incurred during their leave and must pay them in full upon their return.

Comments, suggestions, complaints, or reports of inappropriate or neglectful acts on the part of any employee or Member or Guest of the Club relative to the operation of the Club should be made in writing and addressed to the General Manager of the Club or the Chairman of the House Committee.

20 VIOLATIONS OF RULES
Club management shall inform any Member of the Club of any violation of Club rules whether by the Member or a Guest of the Member, and shall report such violations to the Chairman of the House Committee. The General Manager and the House Committee, with the consent of the Board of Directors, shall develop and disseminate, from time to time, procedural rules for investigation and appropriate action by the House Committee with regard to any violation of the House Rules and the good order of the Club.
